PATTERSON, District Judge.

Suit in equity was brought by the plaintiff against Engel and others, partners in the stockbrokerage firm of Engel & Co., to enjoin them from producing statements of the plaintiff’s account in response to subpoenas issued by. the Securities and Exchange Commission. The Commission was permitted to intervene as a defendant. The matter has been heard on the plaintiff’s motion for preliminary injunction.
