—In a proceeding pursuant to CPLR article 78 to review a determination of the Zoning Board of Appeals of the Village of Bayville, dated June 11, 1998, which, after a hearing, denied the petitioner’s application to maintain the use of a structure as a dwelling, the Zoning Board of Appeals of the Village of Bayville and its members appeal from a judgment of the Supreme Court, Nassau County (Mahon, J.), entered October 11, 2000, which granted the petition, annulled the determination, and directed them to grant the petitioner’s application.
