OPINION AND ORDER

This matter is before the Court after a trial held on May 10 and 11, 2004 in Columbus, Ohio. Defendant filed a Post-Trial Memorandum of Contentions of Fact and Law on June 22, 2004. Plaintiff filed its Post-Trial Proposed Findings of Fact and Conclusions of Law on June 25, 2004. Closing argument was held in Washington, D.C. on August 9, 2004.
