Prank Ketch, plaintiff in error. as plaintiff below, filed this action in the county court of Canadian county to recover of and from defendant, John Smith, the sum of $750 alleged to be due him as his pro rata distributive share and interest in the proceeds of certain building and loan stock belonging to the estate of Caroline E. Smith, deceased, the mother of plaintiff and the wife of defendant, at the time of her death.
