This is an appeal from the Baltimore City Court granting a motion of the appellees to dismiss the appeal of the appellant from the action of the Commissioners for Opening Streets.in the City of Baltimore. The Mayor and City Council of Baltimore passed an ordinance, known as Ho. 387, and approved on the 16th of August, 1909, which provided for the elimination of certain crossings at grade over the tracks of the B. & O.
