This is an appeal from an order of the United States District Court for the District of Columbia. The District Court granted summary judgment in favor of the Department of Defense (“DOD”) and its Commercial Airlift Review Board (“CARB”) and denied the summary judgment motion of Reeve Aleutian Airways, Inc. (“Reeve”). Reeve had requested the District Court to set aside an order of CARB prohibiting Reeve’s participation in DOD’s airlift transportation program and to enjoin CARB’s application of the DOD regulations…
