MEMORANDUM OF DECISION REGARDING MOTION FOR STAY PENDING APPEAL AND REQUEST FOR CERTIFICATION FOR DIRECT APPEAL

I. Introduction

When Robert Louis Marrama (the “Debtor”) filed the above-captioned case, he had a pending Chapter 7 case in which he was denied his discharge. I granted a motion to dismiss this case after I concluded that the Debtor was ineligible to be a Chapter 13 debtor under 11 U.S.C. § 109(e). The Debtor filed an appeal of that order and seeks a stay pending appeal to avoid losing his home to foreclosure. The Debtor also seeks a direct appeal…
