Mason, J.:

George W. Bousman sued the city of Stafford to recover damages for injuries received in a fall caused by a defective sidewalk. A jury found against him, and a judgment was rendered for the city, from which he prosecutes error. The only complaint necessary to be passed upon is based upon the denial of a motion for a new trial on the ground of newly discovered evidence.

One of the important questions of fact tried was whether the plaintiff had actually been hurt at all. No special findings were made, and for anything that appears in the record…
