On March 14, 2001, this Court granted in part, and denied in part, a motion for summary judgment filed by the defendants which was addressed to all counts of the plaintiffs complaint. In that Ruling and Order, the Court noted that the plaintiff, Markos Pappas (“Pappas”), had asserted claims of municipal liability in his opposition papers without seeking leave to amend his complaint to actually assert such claims against the defendant City of New Haven (the “City”).
