This matter is before the court for final disposition of the issue of liability in plaintiffs’ consolidated medical malpractice actions against the United States, which were brought under the Federal Tort Claims Act, 28 U.S.C. §§ 1346, 2671-80. This court has previously addressed certain aspects of these claims, denying defendant’s motion for summary judgment of the parental claim for “wrongful birth,” Phillips v.
