BORAH, Circuit Judge.

Gracie Elmo brought this action against the United States under the Federal Tort Claims Act 1 to recover damages for injuries received when she was struck by a jeep owned by the United States and driven by Sergeant Arthur Lejeune, a member of the Texas National Guard. On the day in question Lejeune was supply-sergeant of Company C, 111th Engineer Combat Battalion, 36th Division, Texas National Guard but what is here important • is the fact that he was also employed as a caretaker of government property assigned to this unit.
