This is an appeal from a judgment of the Superior Court affirming a decree of the Probate Court of the Town of Charlestown that admitted to probate the last will and testament of the decedent and testatrix Lisbeth R. Eglee. The matter was heard without a jury.

The facts are undisputed. The decedent, a resident of Charlestown, Rhode Island, died on November 11, 1973. Subsequently, defendent Donald R. Eglee, who is the stepson and sole beneficiary of Lisbeth R. Eglee, filed a petition with the local probate court requesting that a written instrument, executed and dated by decedent March 7, 1966,…
