[1] This appeal questions a decree of dismissal of a suit brought on May 2, 1907, by the Mound City Company, a corporation of N ew J ersey, and the grantee under a deed made March 30, 1907, by Ben T. Castleman, a son and heir of David Castle-man, against Robert II. Castleman, the only other son of David Castle-man, Ida May Castleman, his widow, one Whitlow, a trustee named in a trust deed of a portion of the property to secure a loan of $2,600, and the lender, for the purpose of obtaining a decree of partition of about 616 acres of land in the state of Missouri which…
