BRYNER, Chief Justice.

I. INTRODUCTION

Soon after Kelly and Connie Carr separated in 2004, Kelly was indicted for sexually abusing minors and possessing child pornog: raphy. Connie then filed for divorcee. With Kelly's consent, Superior Court Judge Eric Smith presided over both the divorce and the criminal cases. After a jury convicted Kelly in the criminal case, Judge Smith held a trial on disputed property issues in the divorce; Kelly participated telephonically from the jail.
