After a marriage lasting a little over 8 years Doris P. Pee sued Judson D. Pee for divorce. She was given temporary custody of the parties’ four minor children but after a hearing on the complaint and cross-complaint a decree was entered awarding the judgment of divorce to Judson Pee and also awarding him permanent custody of the children.

This appeal asserts the trial court erred in granting a divorce to Judson Fee because he was guilty of the same acts constituting grounds for divorce (extreme cruelty) as those alleged against him; that the evidence will not support a finding that the mother…
