MEMORANDUM OPINION

WILLIAM M. TAYLOR, Jr., District Judge.

This suit is for recovery of seniority under the Universal Military Training and Service Act, 50 U.S.C.A.App. § 459, and for back wages which plaintiff has lost if advancement in seniority should be granted. In addition to denying that plaintiff is entitled to seniority advancement, defendant relies upon the Texas statute of limitations and the claim that plaintiff is guilty of laches in asserting his right to advanced seniority.
