In Equity. Suit by Nelson W. Green against the city oí Lynn for the infringement of reissued patent No. 4,372, granted May 9, 1871, to li. W. Preliminary to the final hearing of this case a question of proof arose, which was disposed of at the time without examination of authorities, and should now be restated The defendant called the attention of the court to the opinion of the supreme court in Andrews v. Hovey, 123 U. S. 267, 8 Sup. Ct Rep. 101, reaffirmed February 30, 1888, (124 U. S. 694, 8 Sup. Ct. Rep. 676,) declaring void one of the patents in issue here on the ground of prior public use.
