This is an action of the case in assumpsit. The trial justice in the superior court, at the conclusion of the evidence, directed the jury to return a verdict for the plaintiff for $127.42, the defendant’s plea in set-off being considered. Thereafter the latter duly prosecuted his bill of exceptions to this court, and is now relying upon his exception to the above ruling of the trial justice.
