The action, was instituted by appellants to recover a balance due upon the written obligation of the defendants for the payment of twenty-five hundred dollars, and also for the recovery of reasonable attorneys’ fees, stipulated for in contemporaneous agreement, made to secure the payment of the note or obligation.
