This is the- third appearance before this court of the case now under consideration. See Daniel v. Etheredge, 191 Ga. 793 (13 S. E. 2d, 763), and s. c. 194 Ga. 860 (22 S. E. 2d, 807). The first stated decision contains a very concise and complete statement of the pleadings and contentions of the parties; and therefore no further statement of these matters is deemed necessary.
