OPINION

HORN, Judge.

BACKGROUND

This case is before the court on the motion for summary judgment filed by Snap-On Tools, Inc., the plaintiff, and on the defendant’s cross-motion for summary judgment.1 The instant litigation commenced by the filing of a lengthy complaint, including some 51 paragraphs in which multiple, separate claims were combined in the five counts, with each count representing a different tax year.
