Appeal from Circuit Court, Jefferson County ; C. B. Smith, Judge. Action by the Jennings Produce Company against O. A. Tyson. Judgment for plaintiff after trial before the court without a jury, and defendant appeals.

The complaint, and amendment thereto, was in eight counts. The first six assignments of error relate to the action of the court in its rulings on pleadings, and the ninth assignment of error relates to the action of the court in overruling the defendant’s motion to expunge certain papers from the record.

[1J We have carefully examined, these pleadings and the motion, and are of the opinion that the actions of the trial court in its various rulings were either without error, or, if the court was in error in overruling the defendant’s motion to expunge, such action did not injuriously affect any…
