Defendant appeals from an order denying motion to set aside a default judgment entered against defendant.

FACTS

On 30 December 2005, Juan Ruiz (“plaintiff’), an employee of Virginia-Carolina Paving and Grading Company, filed a complaint against Mecklenburg Utilities, Inc. (“defendant”). According to the complaint, defendant’s negligence caused plaintiff to be injured while working on a water line.
