1Opinion of the Court

IIolt, Judge:

This was an action of assumpsit, brought by the Morgan-town Bank on the 21st day of July, 1881, in the Circuit Court of Tyler county, against C. A. Foster. The declaration avers, in substance, that on the 27th November, 1874, one James Wells executed to C. A. Foster his writing obligatory of that date, whereby he promised and bound himself to pay to Foster on or before the 1st day of April, 1878, the shm of two hundred and fifty dollars; that after-wards, for value received, Foster indorsed and assigned the same to one C.
