Ricardo Villegas was indicted on one count of illegal re-entry into the United States after having been deported previously on account of two aggravated felony convictions, see 8 U.S.C. § 1326(b)(2), and one count of intentional possession of marijuana, see 21 U.S.C. § 844. Mr. Villegas moved to suppress evidence of his identity as the product of an unlawful arrest and detention.
