Appeal from Chambers Circuit Court. Tried before Hon. James E. Cobb. At the Spring Term, 1882, of said court, the appellants, Charles Griffin and Robert Young, were indicted for the murder of William McOau, and at the same term they were tried, convicted of murder in the first degree, and, in accord-anee with the verdict of the jury, were sentenced to suffer death.

Traces, or marks, at or near the scene of the crime, indicative of the presence or proximity of the accused, at or about the time of its commission, are admissible as facts, having a tendency to connect him with the crime.
