MEMORANDUM AND ORDER
VRATIL, District Judge.
This matter comes before the Court on defendant’s Motion to Retax Costs (Doc. # 276), filed February 2, 1995. On September 20, 1994, the Court held a jury trial on plaintiffs claim of retaliatory discharge against his former employer, IBP, Inc. At trial, plaintiff prevailed on the question whether defendant fired plaintiff because he refused to perform work which he was unable to perform due to a work related injury.
