This matter is before the Court on plaintiff’s motion to dismiss counterclaims brought by the defendants. Plaintiff’s motion will be granted in part and denied in part.

FACTS

Plaintiff Surgidev Corporation (Surgidev) is a California corporation with its principal place of business in Goleta, California and is engaged in the manufacture of artificial lenses.
