The plaintiff, then a thirteen-year-old boy, sustained severe and permanent injuries on August 17, 1952, while playing on or about a road grader, owned by the defendant, which was parked near the home of the plaintiff’s father, a tenant of the defendant. In 1959, a jury returned a verdict for the plaintiff to recover a substantial amount of damages from the defendant, and the trial court refused to set it aside.
