— The appellee Carpenter filed this

suit against the Missouri, Kansas & Texas Railway Company of Texas, the Texarkana & Fort Smith Railway Company, and the Kansas City Southern Railway Company, in the Justice Court of Collin County, to recover damages for a delayed shipment of a car of oats. He obtained a judgment in that court for the sum of $109.05 against all of the defendants jointly and severally; and upon appeal to the County Court a verdict was returned in favor of the Texarkana & Fort Smith Railway Company and against the Missouri, Kansas & Texas Railway…
