Plaintiff in error Ben Gamble hereinafter called the defendant, was convicted of violating Ch. 339, Private Acts of 1909, and fined $50. He has appealed and assigned 13 alleged errors.

The issues the Court is requested to determine are (1) the constitutionality of said Private Act; (2) whether or not the indictment charges an offense; (3) whether or not the resolutions providing rules and regulations for compulsory immunization of school children passed by the Davidson County Board of Health are constitutional and binding against the defendant and upon which he can properly be held under the…
