Appeal from District Court, Bastrop County; Ed. R. Sinks, Judge. Action by Dock McDavid against the Houston Chronicle Publishing Company. Judgment for plaintiff, and defendant appeals.

This is the third appeal in this case. At the first trial the court below sustained a general demurrer to the plaintiff’s petition, from which ruling the plaintiff appealed, and this court held that the petition stated a cause of action, and reversed the case. McDavid v. Houston Chronicle Printing Co., 146 S. W. 252. The case went back and was tried upon its merits, and a verdict and judgment rendered for the plaintiff, from which the defendant appealed, and this court reversed the judgment on account of the improper admission of certain testimony.
