Affirming.

At the time of the accident resulting in the injuries and consequent damages sued for, the appellee (defendant below) was engaged, under a contract with the government of the United States, in constructing a lock and dam upon the Ohio river in Mason county, and the appellant (plaintiff below) was the foreman of a gang or crew of men who were engaged in driving piling in connection with the,construction of a coffer dam, it being a part of the entire work covered.by the contract.
