MEMORANDUM OPINION AND ORDER
WOLSKI, Judge.
The matter before the Court is the application of plaintiff Beta Analytics International, Inc. (“BAI” or “Beta”) for an award of bid preparation and proposal costs, brought under 28 U.S.C. § 1491(b)(2). The Court had previously determined—after contract performance had already begun—that the government acted arbitrarily and capriciously in awarding a Defense Advanced Research Projects Agency (“DARPA”) contract to intervenor Maden Tech Consulting, Inc., see Beta Analytics Int’l v.
