MEMORANDUM OPINION AND ORDER

FLOYD, District Judge.

I. INTRODUCTION

This is a petition for writ of habeas corpus, filed pursuant to 28 U.S.C. § 2241. The Court has jurisdiction over the subject matter under 28 U.S.C. § 1331. The mat ter is before the Court for review of the Report and Recommendation (Report) of the United States Magistrate Judge recommending that the Court dismiss the petition. The Report is made in accordance with 28 U.S.C. § 636 and Local Civil Rule 73.02 for the District of South Carolina.
