I respectfully dissent from the reversal of the judgment. I agree that we possess jurisdiction to entertain al-Marri’s habeas petition. I also believe the district court to be right in all respects and that its judgment dismissing the petition should be affirmed.

I wish to express my respect for those who see this matter differently. ' I admire the skill with which my fine colleagues and the principal and amicus briefs have argued the case for reversal, and I respect the sense of conviction and principle that animates their views.
