Pending before this Court is defendants’ motion to dismiss pursuant to Federal Rules of Civil Procedure 12(b)(1) and 12(b)(6) or, in the alternative, for summary judgment pursuant to Rule 56(c). For the reasons stated hereinafter, we deny defendants’ motion as to Count I of the complaint, which alleges a violation of 42 U.S.C. § 1981, and Count III of the complaint, which alleges a violation of 42 U.S.C. § 2000e — 16, and grant defendants’ motion to dismiss as to Count II of the complaint, which is based on an alleged violation of 42…
