Before the Court is a motion by the Official Committee of Creditors Holding Unsecured Claims of ICS Cybernetics, Inc. (“Committee”), pursuant to Bankruptcy Rule (“Bankr.R.”) 7037 and Federal Rule of Civil Procedure (“Fed.R.Civ.P.”) 37(a), to compel Jonathan W.
