OPINION and ORDER

KOELTL, District Judge.

The defendants — Ahmed Abdel Sattar (“Sattar”), Lynne Stewart (“Stewart”), and Mohammed Yousry (“Yousry”) — were charged in a seven-count superseding in- dietment (“SI Indictment”) filed on November 19, 2003. Count One of the SI Indictment charges Sattar, Stewart, and Yousry with conspiring to defraud the United States in violation of 18 U.S.C. § 371. Count Two charges Sattar with conspiring to murder and kidnap persons in a foreign country in violation of 18 U.S.C. §§ 956(a)(1) and (a)(2)(A).
