1Opinion of the CourtLeis, J.

This matter is now before tbe Court on a demurrer filed by defendant Sam B. Marting, and a demurrer filed jointly by defendants Griffith and Malone. Both demurrers state tbe following grounds:

1. That tbe Amended Petition does not state facts which show a cause of action.

2. That tbe causes of action purportedly set forth in tbe Amended Petition did not accrue within tbe time limited by statute for tbe commencement thereof.

*477The demurrer of defendants Griffith and Malone also sets forth a third ground, namely:

3. That the plaintiff does not have legal capacity to bring this action.
