OPINION AND ORDER
GEORGE C. SMITH, District Judge.
Plaintiff, National Solid Waste Management Association (NSWMA), brings this action challenging the constitutionality of certain provisions of Ohio’s solid waste disposal statute. Ohio Rev.Code § 3734.131 and § 3734.57. The NSWMA asserts that the Act violates the Commerce Clause of the U.S. Constitution, art. L, § 8, by discriminating against and placing undue burdens on interstate commerce.
