On March 7, 1956, Wright Adams, defendant herein, entered into a written contract with the plaintiff1 to paint the ex*598terior- and interior, and do the sheetrock work on the home of Dr. C. B. Pennington, which Adams had contracted to construct. Prior to the completion of the house a difficulty or dispute arose between the plaintiff and defendant which resulted in the latter employing Adam Lanehart to do certain work, which they contended should have been done by the plaintiff under his contract.
