Petitioners challenge the legality of certain emergency regulations promulgated by respondent requiring sponsors of condominium and cooperative housing ventures to disclose the presence of asbestos containing material (referred to as ACM by the parties), and to take certain remedial measures to correct any hazard created by the ACM. General Business Law § 352-e is the operative provision mandating that any person or entity offering interests in real estate must make various disclosures relative to the venture.
