Criminal prosecution tried upon an indictment charging the defendant with rape.

The prosecutrix, a woman 52 years of age and a partial invalid, resided in Salem Chapel Township, in Forsyth County, with her father, who is 82 years of age and partially deaf. On Sunday night, 30 November, 1941, the prosecutrix retired between 10:30 and 11:00 o'clock. She slept upstairs and her father slept downstairs.
