Before the Court is the jurisdictional issue of whether the appellant’s Notice of Appeal (NOA) was timely filed either under 38 U.S.C. § 7266(c)(2) or by virtue of applying the principles of equitable tolling to the 120-day judicial-appeal period found in 38 U.S.C. § 7266(a).
