NORTON, District Judge.

This matter is before the court on plaintiffs motion to dismiss defendants’ counterclaim for lack of jurisdiction, pursuant to Fed.R.Civ.P. 12(b) and 12(c).

I. BACKGROUND

In the late evening of January 3, 1992 or the early morning of January 4, 1992, a number of containers loaded with drums of arsenic trioxide were lost overboard from the vessel M/V SANTA CLARA I during a severe storm in the Atlantic Ocean off the coast of New Jersey. 1 The loss of the drums overboard resulted in a response by the United States, led by the United States Coast Guard (hereinafter…
