This is an action under the Administrative Procedure Act (“APA”), 5 U.S.C. §§ 701 et seq., for judicial review of a final decision issued by the Secretary of the United States Department of Health and Human Services (“HHS”) on August 24, 2005, denying the plaintiffs request that the Secretary void an adverse action report concerning him that was filed with the National Practitioner Data Bank on April 6, 2005, by Gothenburg Memorial Hospital (“GMH”), located in Gothenburg, Nebraska.
