The Act of Congress of September 4th, 1841, “ To Appropriate the Proceeds of the Sales of the Public Lands, and to Grant Preemption Rights,” in its tenth section authorizes the entry by individuals, in certain- cases, of portions of the public lands, not exceeding one hundred and sixty acres, upon paying the minimum price of the same to the United States; in other words, confers preemptive rights or privileges upon individuals on compliance with certain conditions.
