BELL, Chief Justice.
Linda Lou Rose, an eight year old girl, through next friends and guardians, Charles E. Rose, Jr., et ux., brought suit against Missouri Pacific Railroad Company and W. E. Smith, one of the Railroad employees, to recover damages for injuries sustained by her when an automobile driven by her father was in collision with a “gondola” car of the Railroad Company at a point in the City of Angleton where the railroad lines cross State Highway 288.
