Defendant Roy L. Peters appeals from a conviction of the *191crime of receiving stolen property, and from the denial of a motion for a new trial.

On April 14, 1964, the Fergus County Attorney made a motion for leave to file an information charging defendant, hereinafter called appellant, with the crime of receiving stolen property.
